Extension of Residency Requirement
- The UK government intends to establish stricter regulations which will govern permanent residency rights. Shabana Mahmood indicated that the required residency period may increase.
- The current system permits migrants to seek permanent residency after they complete five years of residence. The new proposal extends the required residence period to a duration of ten years. Some visa categories require applicants to complete a waiting time of twenty years before they become eligible for permanent residency.
Stricter Eligibility Criteria
The proposed rules establish more restrictive eligibility requirements. Migrants must meet the following requirements:
- No criminal record
- Higher level of English language proficiency
- Stable financial record
Current rules require applicants to earn more than £12,570 per year over the last three years. The updated system will maintain these financial conditions.
Impact on Migrants
The changes will impact multiple groups with different levels of intensity:
- Individuals with limited access to full-time jobs
- Refugees
- Family visa holders
- Workers on temporary or lower-income visas
These groups will experience lengthier waiting times because of tougher criteria which they must meet to qualify.
Possible Exceptions
The system maintains some degree of operational flexibility. The ten-year requirement will apply to individual situations.
Certain groups may still qualify earlier:
- NHS workers, including nurses and doctors
- Highly skilled professionals
- Individuals earning above £12,140 annually
These applicants may remain eligible for permanent residence within three to five years depending on their category.
