Government Announces New Online Gaming Rules Effective May 1

The Central Government has implemented new regulations which establish rules for online gaming operations throughout India. The new regulations establish a framework which permits authorities to oversee gaming operations that involve monetary bets according to existing legal requirements. The rules will take effect from May 1.

Overview of the New Law

The Online Gaming Promotion and Regulation Act, which received approval from Parliament last year, contains the rules which establish its operational framework. The legislation establishes methods to manage online gaming operations which include activities that use real money. The law establishes a method to categorize games into two groups which include permitted games and prohibited games.

When the Rules Will Take Effect

The government has confirmed that the rules will come into force on May 1. The new regulatory system will start its operations from this date onward.

Which Games Are Covered by the Rules

  • The law mainly targets games that involve monetary stakes. These types of games fall under stricter control. Most online gaming activities, except for specific cases, remain outside the scope of strict regulation.
  • E-sports games exist as their own distinct category. The law recognizes them as official entities which must follow particular legal obligations.

Registration Requirements Explained

  • IT Secretary S. Krishnan states that online games which lack real money elements will not require players to register their games. This reduces the burden on developers of casual or entertainment-based games.
  • The registration process applies only to e-sports games. The government will review certain social games to determine if they require mandatory registration. The regulatory authority has the power to start an investigation and order a game evaluation at their discretion.

How Games Will Be Classified

  • The system allows developers to choose how they classify their games. They have three options to label a game which are money-based game and social game and e-sport. Most situations do not require players to make this classification choice.
  • The authority retains the option to evaluate and categorize a game without any external input. The system ensures that games meet legal requirements because developers must submit their games for evaluation.

Creation of the Online Gaming Authority

The government will establish an Online Gaming Authority to enforce the regulations. This body will oversee the sector and decide which games comply with the law. It will also handle cases where classification or registration is required.

Structure and Members of the Authority

The Authority will consist of six officials from different government departments. The Ministry of Electronics and IT will designate its Additional Secretary to serve as Chairperson.

Other members will include Joint Secretaries from:

  • Ministry of Home Affairs
  • Department of Economic Affairs
  • Ministry of Information and Broadcasting
  • Ministry of Youth Affairs and Sports
  • Ministry of Law

These members will serve in an ex-officio capacity, meaning they hold these roles as part of their existing positions.
