Top Court Issues Disciplinary Order Against Officer
The Supreme Court of India has taken strict action against Deputy Collector Tata Mohan Rao for disobeying a previous High Court directive. He has been replaced by the Court from the position of Deputy Collector to Mandal Revenue Officer (MRO).
Judgment Issued by Justice BR Gavai’s Bench
Justice BR Gavai, the presiding officer of the bench, cautioned that the law has to be respected by the government officials. The bench ordered the Chief Secretary of Andhra Pradesh to implement disciplinary action against Mohan Rao. It made it clear that no official is above the law.
Background of the Case
On December 11, 2013, the Andhra Pradesh High Court directed Tata Mohan Rao, who was the Guntur Tahsildar at that time, not to demolish encroachments in a particular Guntur locality. He demolished them in 2014 despite the direction.
Earlier Contempt Judgment and Supreme Court Appeal
Since he was disobedient to the orders of the court, the High Court imprisoned him for two months. He was later given the position of Deputy Collector. He appealed this punishment to the Supreme Court. But the Supreme Court upheld the previous judgments and reduced his rank to that of Tahsildar.
